Terms of Service

PADDY HANLEY

Effective date: 13 October 2026

1. Introduction

Welcome to Paddy Hanley.

These Terms of Service (“Terms”) govern your access to and use of our website, online store and related services, including purchases of our candles, home fragrance products and associated merchandise.

Paddy Hanley (“Paddy Hanley”, “we”, “us” or “our”) is a luxury candle and home fragrance brand founded in 2026 in Abu Dhabi, United Arab Emirates (UAE).

Throughout these Terms, “you” and “your” refer to any individual accessing our website, browsing our products or purchasing from us.

By accessing our website or placing an order, you agree to be bound by these Terms and any policies expressly incorporated into them. If you do not agree, please discontinue use of our website.

These Terms should be read alongside our Privacy Policy, Shipping Policy and Returns and Refunds Policy, where applicable.

Nothing in these Terms is intended to exclude or restrict any consumer rights that cannot lawfully be excluded or restricted under applicable law.

2. Eligibility and Use of Our Website

By using our website, you confirm that you are legally capable of entering into a binding agreement under the laws applicable to you.

If you make a purchase on behalf of another person or an organisation, you confirm that you have the authority to do so.

You agree to use our website lawfully and responsibly. You must not:

  • Use our website for fraudulent, unlawful or unauthorised purposes.

  • Interfere with the operation, security or integrity of our website.

  • Attempt to gain unauthorised access to our systems, accounts or customer information.

  • Introduce malicious software, harmful code or other disruptive material.

  • Use automated systems to extract website content or product information in a manner that breaches applicable law or our rights.

  • Misrepresent your identity or provide materially false information when placing an order.

We reserve the right to restrict access to our website where reasonably necessary to protect our customers, business or systems, subject to applicable law.

3. Our Products

Paddy Hanley creates and offers candles and home fragrance products intended to bring fragrance, atmosphere and character to the home.

We take reasonable care to ensure that product descriptions, photographs, dimensions, fragrance notes, ingredients and other product information are presented accurately.

However, certain differences may occur between a product's online representation and the physical item, including differences arising from:

  • Screen settings, lighting and photographic conditions.

  • The appearance of natural wax, fragrance materials or other product components.

  • Variations in colour, texture or finish inherent in the manufacturing process.

  • Reasonable changes to packaging or presentation that do not materially alter the product.

Such differences do not remove or limit any rights you may have where a product is defective, unsafe, misdescribed or otherwise fails to comply with applicable law.

Fragrance is subjective, and individual perceptions of scent may differ. A fragrance description expresses the intended scent profile of a product and does not guarantee that every customer will perceive it in the same way.

Unless expressly stated otherwise, product photographs are illustrative of the product being offered.

4. Product Availability

All products are offered subject to availability.

As certain collections or products may be released in limited quantities, we cannot guarantee that a product will remain available after you have viewed it or added it to your shopping cart.

Adding a product to your cart does not constitute acceptance of an order or guarantee that the product will be reserved for you.

If a product becomes unavailable after an order has been placed and paid for, we will contact you and arrange an appropriate resolution, including a refund where applicable.

We reserve the right to discontinue products, introduce new collections or modify product offerings. Such changes will not remove rights arising from an existing order or under applicable law.

5. Prices, Currency and Taxes

All prices are displayed in the currency indicated on our website at the time of purchase.

Prices, product availability and promotional offers may change from time to time. The price applicable to your order will ordinarily be the price presented at checkout when you submit the order, subject to correction of a genuine pricing error and applicable law.

Unless expressly included in the displayed price, additional charges may apply for shipping, delivery, taxes, customs duties or other applicable fees. These charges will be disclosed at checkout where they can reasonably be calculated in advance.

For international orders, customs duties, import taxes and other charges may be imposed by the destination country. Responsibility for these charges will depend on the delivery terms, applicable law and the information disclosed to you before purchase.

We will not knowingly use a pricing error as a means of charging a customer an undisclosed amount. If a material pricing error is identified, we will take appropriate steps to resolve it fairly and lawfully.

6. Orders and Contract Formation

When you place an order through our website, you are making an offer to purchase the selected products on the terms presented at checkout.

After submission, you may receive an automated order acknowledgement. This acknowledgement confirms receipt of your order but does not necessarily constitute final acceptance.

A binding sales contract is formed when your order is accepted by us, as indicated by the relevant confirmation or other acceptance communicated through our ordering process, subject to applicable law.

We reserve the right to decline or cancel an order where reasonably justified, including where:

  • A product is unavailable.

  • Payment cannot be authorised or completed.

  • There is a genuine pricing or listing error.

  • We reasonably suspect fraud or unauthorised activity.

  • Delivery to the supplied address is not possible.

  • A legal or regulatory restriction prevents fulfilment.

Where an order is cancelled after payment has been taken, we will arrange an appropriate refund in accordance with applicable law and the circumstances of the cancellation.

We will not rely on this section to avoid fulfilling an accepted order without a lawful reason.

Please ensure that your contact details, delivery address and order selections are correct before completing checkout. If you identify an error after ordering, contact us promptly. We will make reasonable efforts to assist, but changes may not be possible once an order has entered fulfilment.

7. Payment

Payment must be completed using one of the payment methods made available at checkout.

Payments are processed through the relevant payment service providers and the payment infrastructure supporting our online store.

By submitting payment information, you confirm that you are authorised to use the selected payment method.

We do not guarantee that every payment method will be available at all times. Transactions may be declined, delayed or subject to additional verification by the relevant provider.

We reserve the right to suspend fulfilment of an order where payment has not been successfully authorised or where a legitimate payment-security concern requires investigation.

Refunds, where due, will ordinarily be returned through the original payment method unless otherwise agreed or required by law.

8. Shipping and Delivery

We aim to process and dispatch accepted orders within the timeframes communicated on our website or at checkout.

Delivery estimates are provided in good faith but may be affected by circumstances beyond our reasonable control, including courier delays, customs procedures, adverse weather, public holidays or operational disruptions.

Unless a delivery date has been expressly agreed as binding, any estimated delivery date is indicative rather than guaranteed.

You are responsible for providing an accurate and complete delivery address and any necessary contact information.

If delivery fails because of incorrect information supplied by you, refusal to accept delivery or repeated unsuccessful delivery attempts, we may need to arrange an alternative delivery or return-to-sender process. Any additional charges will be handled in accordance with the disclosed shipping terms and applicable law.

Responsibility for loss or damage during delivery will be determined in accordance with applicable law and the delivery arrangement. Nothing in these Terms transfers risk to a consumer earlier than the law permits.

If your order arrives damaged, incomplete or incorrect, please contact us as soon as reasonably possible and provide your order number and, where helpful, photographs of the issue.

Further information is available in our Shipping Policy.

9. Returns, Refunds and Cancellations

We want our customers to have confidence when purchasing from Paddy Hanley.

Our Returns and Refunds Policy explains the procedure for requesting a return, exchange, refund or cancellation, including any applicable conditions and timeframes.

Any return conditions will be applied consistently with applicable consumer protection legislation.

Where permitted by law, certain restrictions may apply to products that have been used, damaged after delivery through customer misuse, or personalised at the customer's request. However, such restrictions will not override rights relating to defective, unsafe, misdescribed or non-conforming products.

Where a product is faulty or an order is incorrect, we will assess the matter and provide the remedy required by applicable law.

Nothing in these Terms excludes a statutory right to cancel, return or obtain a refund where that right applies.

Please consult our Returns and Refunds Policy before placing an order.

10. Product Safety and Candle Use

Candles involve an open flame and must be used responsibly.

You are responsible for following the safety instructions supplied with the product and any warnings displayed on its packaging or label.

As a minimum, candles should be used in accordance with the following precautions:

  • Never leave a burning candle unattended.

  • Keep candles away from children, pets, draughts and flammable materials.

  • Place candles on a stable, heat-resistant surface.

  • Keep burning candles appropriately separated from one another.

  • Keep wax, wick trimmings and foreign objects away from the flame.

  • Avoid moving a candle while the wax is hot or liquid.

  • Extinguish a candle before leaving the room or going to sleep.

  • Discontinue use when the remaining wax or product condition reaches the safe-use limit indicated by the manufacturer.

Additional product-specific instructions may apply.

Our products must be used only for their intended purpose and in accordance with the instructions supplied. Candles must not be ingested or used as food, cosmetics or therapeutic products unless a product is expressly designed and lawfully marketed for that purpose.

Failure to follow safety instructions may create a risk of fire, burns or property damage. However, nothing in these Terms excludes or limits liability for defective or unsafe products, negligence or other liability that cannot lawfully be excluded.

11. Intellectual Property

All intellectual property associated with the Paddy Hanley brand and website is owned by or licensed to Paddy Hanley, except where otherwise indicated.

This includes, without limitation:

  • The Paddy Hanley name, logos and brand marks.

  • Product names, collection names and written descriptions.

  • Website copy, photographs, graphics and visual compositions.

  • Packaging artwork, label designs and brand illustrations.

  • Website layouts, original design elements and other creative materials.

These materials are protected by applicable intellectual property laws.

You may access our website and use its content for personal, non-commercial purposes associated with browsing and purchasing our products.

You must not, without prior written permission or another lawful basis:

  • Copy, reproduce or distribute substantial portions of our content.

  • Use our branding or logos in a manner suggesting an unauthorised association.

  • Reproduce our product photography, packaging artwork or original designs for commercial purposes.

  • Modify, republish or commercially exploit our creative materials.

  • Use our intellectual property in a way that infringes our rights or misleads customers.

Nothing in this section restricts rights that applicable law expressly permits.

12. Personalised Products

Where personalisation is offered, you are responsible for ensuring that the names, wording, spelling and other details submitted with your order are accurate.

You confirm that you have the necessary rights or permissions to provide any text, names or other material submitted for personalisation.

We reserve the right to refuse content that is unlawful, infringes another person's rights or is otherwise reasonably inappropriate for our services.

Personalised products may be subject to specific production, cancellation and return conditions disclosed before purchase. Any restrictions will remain subject to applicable consumer protection law.

We will make reasonable efforts to reproduce the details submitted by you, but customers should carefully review all information before confirming a personalised order.

13. Promotions and Discount Codes

Promotional offers, discount codes and special releases may be subject to specific conditions, including eligibility, validity periods, minimum purchase requirements or product exclusions.

Unless expressly stated otherwise, promotions cannot be assumed to apply retrospectively to completed purchases or be combined with other offers.

Promotions will be administered in accordance with the conditions communicated when the offer is made and applicable law.

We reserve the right to correct genuine promotional errors or withdraw an offer where reasonably necessary and lawful. Such action will not retrospectively remove rights arising from an offer already accepted or a binding order already placed.

Any additional terms accompanying a specific promotion form part of the applicable offer.

14. Website Availability and Third-Party Services

We aim to maintain a reliable and accessible website. However, we do not guarantee uninterrupted access or that every website feature will always operate without error.

Maintenance, software updates, technical failures and circumstances beyond our reasonable control may occasionally affect availability.

Our website may include links to third-party websites, payment services, social media platforms or other external resources. These services are not necessarily controlled by Paddy Hanley and may operate under separate terms and privacy policies.

We are not responsible for the content or operation of third-party services to the extent permitted by law. This does not affect any responsibility we retain for our own services or any rights you may have under applicable legislation.

15. Limitation of Liability

Nothing in these Terms excludes, restricts or limits any liability or consumer right that cannot lawfully be excluded, restricted or limited under applicable law.

Subject to that principle, Paddy Hanley will not be responsible for losses that are not reasonably foreseeable consequences of a breach of these Terms, where such exclusion is permitted by law.

We are not responsible for losses caused solely by circumstances outside our reasonable control, provided that this does not remove any obligation to provide a remedy where required by law.

You remain responsible for using our products in accordance with their instructions and warnings. This does not absolve Paddy Hanley of responsibility for any defective or unsafe product or for any other liability that cannot lawfully be excluded.

Where permitted by law, we are not responsible for interruptions or failures attributable to independent third-party systems, provided that any applicable statutory rights and our own contractual obligations remain unaffected.

Nothing in this section limits liability for fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be limited.

16. Events Beyond Our Reasonable Control

We will not be treated as being in breach of these Terms to the extent that performance is prevented or materially delayed by an event beyond our reasonable control.

Such events may include natural disasters, extreme weather, epidemics, armed conflict, governmental restrictions, widespread transport disruption, major utility failures or significant interruptions to essential third-party services.

We will take reasonable steps to minimise the impact of such events and resume performance when reasonably possible.

If an event materially affects an existing order, we will communicate with affected customers where appropriate and provide any cancellation, refund or other remedy required by applicable law.

This section does not remove any consumer rights that remain available in the circumstances.

17. Privacy and Personal Information

Our collection and use of personal information are governed by our Privacy Policy.

Information provided when you place an order or contact us will be processed for purposes such as transaction fulfilment, customer service, security, legal compliance and other purposes described in that policy.

Where consent is required for marketing or non-essential tracking technologies, we will obtain and manage that consent in accordance with applicable law.

Please review our Privacy Policy for further information about data collection, disclosures, retention, international transfers and your privacy rights.

18. Complaints and Customer Support

If you have a question, complaint or concern about an order or our services, we encourage you to contact us directly so that we can attempt to resolve the matter promptly and fairly.

Please include your order number, relevant details and any supporting evidence that may help us investigate.

We will review complaints in good faith and seek to provide a response within a reasonable period, taking into account the nature of the issue and any applicable legal deadlines.

Nothing in this section prevents you from contacting a relevant consumer protection authority or pursuing any other remedy available under applicable law.

19. Governing Law and Disputes

These Terms are intended to operate consistently with the laws of the United Arab Emirates, including applicable federal legislation and the relevant laws and regulations of Abu Dhabi.

Subject to mandatory consumer protection rules and any applicable conflict-of-law requirements, disputes arising out of or in connection with these Terms will be subject to the jurisdiction of the competent courts of the UAE.

Nothing in this section deprives a consumer of a mandatory right or remedy available under applicable law, including any mandatory rules concerning jurisdiction.

We encourage customers to contact us first to seek an amicable resolution before commencing formal proceedings, where appropriate.

20. Changes to These Terms

We may update these Terms from time to time to reflect changes to our products, services, business practices or legal obligations.

The latest version will be published on our website with an updated effective date.

Changes will apply prospectively from the date indicated, unless a different application is permitted by law. Changes will not retrospectively remove rights or alter obligations arising from an existing order without an appropriate legal basis.

Where required, we will provide additional notice or obtain agreement before applying material changes.

We encourage you to review these Terms periodically.

21. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, where legally permissible.

If it cannot be made enforceable, it will be severed from the remaining provisions.

The remaining provisions will continue to apply to the extent that they remain lawful and enforceable.

22. Entire Agreement

These Terms, together with the policies and conditions expressly incorporated into them, constitute the agreement governing your use of our website and the matters they address.

Any additional terms applicable to a specific product, service or promotion will apply where they have been properly communicated and are legally enforceable.

Nothing in this section excludes any representation, statutory right or obligation that cannot lawfully be excluded.
